Something rotten in Pennsylvania ~ By Patrick J. Buchanan

Bill Clinton and Joe SestakBefore you read Pat's column, you should know that the problem with Sestak has been solved since this column was published. Apparently, if you can believe it, the White House had requested Bill Clinton to urge Rep. Joe Sestak (D-PA) to drop out of the race for Arlen Spectre's Senate seat. But as a tweeter, jimgeraghty, tweeted jokingly, "I want you to listen to me. I'm gonna say this again. I did not... have... effectual conversations with that man... Mr. Sestak." In other words, does anyone believe this White House spin? I believe that a tweet written by Fred Thompson amplifies that sentiment: "Re: Clinton & Sestak: the point man on this credibility issue is only President in history to have been impeached for perjury."

With that being said, I can say that I agree with Pat on his assessment, even if we can all legitimately suspect that the matter is being swept under the rug. At any rate, Pat's column does contain some interesting history about other "political deals" that have gone unpunished. Will the Sestak deal go the same way? Do you really think Eric Holder will get a special prosecutor to investigate any improprieties? Are we to believe the only President in history to have been impeached for perjury? The White House is apparently thinking that Clinton's explanation has solved the problem. That's their plan and they're sticking to it. Just sayin'...

Holder should immediately alert the White House counsel's office to gather and preserve all files, records of interrogations and e-mails related to an investigation that exonerated, or perhaps whitewashed, the White House.

Before voters go to the polls, especially before they choose a senator in Pennsylvania, this smelly deal needs to be aired out.

When does a political deal become a bribe?

At the 1952 Republican National Convention, California's favorite son, Gov. Earl Warren, released his delegation reportedly in return for Ike's promise that he would give Warren the first open seat on the Supreme Court.

In September 1953, Chief Justice Fred Vinson dropped dead of a heart attack. As they say, the rest is history.

In 1824, Andrew Jackson won a plurality of both the popular and electoral votes, but not a majority. Secretary of State John Quincy Adams came in second; Speaker of the House Henry Clay fourth.

Between Jackson and Clay, however, there was a great hate. When Gen. Jackson had gone rogue in Florida, hanging two British subjects for aiding renegade Indians and packing the Spanish governor onto a boat to Havana, almost igniting war with Spain and Britain, Clay had charged Jackson with Caesarism.

The general told friends that when Congress adjourned, he was going to challenge Clay to a duel and kill the speaker of the House.

With no majority in the Electoral College, the contest went to the House. There, Speaker Clay persuaded supporters to back Adams, who emerged with a 13-7 victory among state congressional delegations.

Jackson's supporters were doubly enraged when Adams named as his secretary of state – stepping stone to the presidency for Jefferson, Madison, Monroe and Adams himself – Henry Clay.

"Corrupt bargain!" went the cry. No investigation was held, but a disgusted nation would give Jackson two terms as president and deny Clay his life's ambition in all three of his runs.

At his death in 1845, Jackson reportedly told friends he had but two regrets – that he had not "hanged (John) Calhoun and shot Clay."

Which brings us to Rep. Joe Sestak's claim that he was offered an administration job if he would abandon his race against Sen. Arlen Specter for the Democratic nomination in Pennsylvania. Reportedly, the job offered to the retired admiral was secretary of the navy.

On May 18, Sestak won that primary, and his charge that he was proffered a White House bribe, or deal, went viral.

So, today, Joe has a problem. And so does the White House.

For if Sestak was offered a high post in the administration to abandon his challenge to a U.S. senator endorsed by Obama, this would seem on its face a criminal violation of federal law.

All seven Senate Republicans on the judiciary committee have written Attorney General Eric Holder calling for an independent counsel to investigate the alleged bribe. They cite 18 U.S. Code Section 600, which forbids the offer of any government job "as consideration, favor or reward for any political activity" or "in connection with any primary election or political convention or caucus held to select candidates for any political office."

If Sestak was offered a high government post to get out of the Pennsylvania race, it would appear an open-and-shut case that a felony was committed by someone high in the White House.

When CNN's John King suggested that such an offer "marches up into the gray area, perhaps the red area of a felony, it is a felony to induce somebody by offering them a job," White House adviser David Axelrod did not disagree with King: "If such things happened, they would constitute a serious breach of the law."

However, Axelrod assured King, "when the allegations were looked into, there is no evidence of such a thing."

And who looked into the allegation that a bribe was offered to Sestak and found "no evidence" of White House wrongdoing?

Kagan shielded Saudis from 9/11 lawsuit

Is Elena Kagan a good or bad choice to be a Justice on the Supreme Court? This one column about Kagan by Aaron Klein doesn't make the case either way, but it is important to look at all of the information that is available about her, and then make the decision. The problem is, will the Senate actually do that, or will she get the typical rubber-stamped confirmation?

Cozen, meanwhile, told WND he believes Kagan is "eminently qualified" for the Supreme Court. Still, he said he is concerned about her decision in his case and hew views on the separation of powers.

WND recently reported Kagan has advocated for an increased presidential role in regulation, which, she conceded, would make such affairs more and more an extension of the president's own policy and political agenda.

Obama nominated Kagan as U.S. solicitor general in January, and the Senate confirmed her in March. She was a dean of Harvard Law School and previously served alongside Obama as a professor of law at the University of Chicago.

A former clerk to Abner Mikva at the D.C. federal appeals court, Kagan was heavily involved in promoting the health-care policy of the Clinton administration.

Sided with kingdom in case brought by victims of terror attacks

NEW YORK – President Obama's nominee for the Supreme Court, Elena Kagan, helped shield Saudi Arabia from lawsuits filed by families of 9/11 victims seeking to target countries and leaders who helped finance al-Qaida.

"I'm very concerned about her views on executive power and her views with respect to the separation of power," Stephen A. Cozen, the lead attorney in the case for 9/11 victims, told WND.

"I believe she must be asked questions about whether or not citizens who are attacked inside the U.S. have the right to file suits domestically against terrorism financiers," said Cozen, the founder and chairman of Cozen O'Connor, a Philadelphia-based law firm with 24 offices throughout the country.

Cozen recounted to WND an April 2009 meeting he held with Kagan to present the case for his clients – thousands of family members and others affected by the Sept. 11, 2001, attacks who sought damages from the Saudi kingdom, Saudi high commissioners and the country's rulers.

Cozen's suit documented evidence the Saudis funneled millions of dollars to al-Qaida prior to the 9/11 attacks and that the kingdom continued to finance terrorism thereafter.

He was arguing to bring his case to the Supreme Court after it was dismissed by a lower court and an appeals circuit, which had cited the Foreign Sovereign Immunities Act of 1976 as barring lawsuits against leaders of foreign governments.

Cozen, however, documented how both the Supreme Court and U.S. government briefs allowed for such lawsuits in the past, finding the Immunities Act did not hold in similar cases.

Kagan's friend-of-the-court brief argued Cozen's case would interfere with U.S. foreign policy. She urged the Supreme Court not to hear the case.

In her brief, Kagan acknowledged inconsistencies with the lower court rulings and even conceded there were legitimate questions about whether the Immunities Act should apply in Cozen's case for the 9/11 victims.

Still, she sided with the Saudis, who had presented their case directly to Kagan that the terror victims lawsuit was harming U.S.-Saudi relations.

The Supreme Court sided with Kagan and refused to hear the case.

Kagan's brief prompted Sens. Arlen Specter, D-Pa., and Sen. Lindsey Graham, R-S.C., to submit a bill to amend the Foreign Sovereign Immunities Act.

Specter at the time strongly denounced Kagan.

"She wants to coddle the Saudis," he said.

Defending Obamacare with 'misinformation' ~ By Herman Cain

In interview after interview, the Democrats and the administration are sticking to their script of lofty advantages and misinformation. Sen. Arlen Specter and Secretary of Health and Human Services Kathleen Sebelius were booed at a standing-room-only town hall meeting in Philadelphia last Saturday, trying to defend Obamacare. They did not expect some informed people to show up with very clear and specific questions they could not answer.

The degree to which President Obama is being misinformed or just uninformed is staggering! But misinforming the uninformed appears to be the Democrats' strategy to defend their health-care deform legislation.

In a nationally televised broadcast interview Friday on CBS' "The Early Show," Obama said "this country was going to go bankrupt" without forcing changes to the health-care system. He believes it was "the right thing to do."

The uninformed in this country believes it was the right thing to do because Obama said so. Some of us are not so gullible because we are aware of the gimmicky accounting and fuzzy assumptions that got them the projection they wanted from the Congressional Budget Office. Some of us are also aware of the 159 new boards and commissions created in the bill. Some of us are aware of the host of sneak-a-taxes in the bill, and the expansion of the powers of the Internal Revenue Service to become the health-care police.

Some of us are keenly aware that the Obamacare legislation will ultimately lead to health-care rationing similar to the systems in Canada, England, Germany and other European countries. But the Obama cheerleaders don't care.

Some of us are also aware that the recently passed health-care bill plus the tsunami federal spending, plus the unprecedented buildup of the national debt, plus Social Security, Medicare and Medicaid deficit spending are the real reasons we are heading toward a bankrupt America. There's a deafening silence from the president and Congress about these issues because it does not advance their political agenda.

The Sestak Controversy has the Potential to be Obama’s Watergate

Here is a very interesting story that I had not heard about tonight. The state-controlled lamestream media has obviously kept the story buried far below the radar.

(My thanks to AlinskyDefeater on Twitter for letting us know about this potential disaster for the Obama Administration!)

As we all learned during Watergate it is often the cover up and not the actual act that brings down those in the highest offices. The longer the White House stonewalls on the Sestak issue the more likely that, if a scandal is uncovered, it will reach higher and higher in the Obama White House.

Will we all look back someday and wonder why the nation was so transfixed on Health Care Reform while a scandal was brewing capable of bringing down an Administration? Because the White House continues to avoid questions, there is no way to know at this time.

As I noted in an earlier post, the claims of Representative Joe Sestak against the White House could result in a criminal investigation. Now, Congressman Darrell Issa is suggesting that if the White House continues to stonewall on the matter that, "If the public doesn’t receive a satisfactory answer, the next step would be to call for a special prosecutor, which is well within the statute."

This story has the potential to be one of the biggest, if not the biggest story of the Obama Administration, and yet somehow it is flying under the radar at present.

By Erik Rush I have been asked – very frequently, of late – the question that Republicans the nation over are asking: What might they do, what strategy might they employ to regain a majority in the House and Senate, and ultimately retake the White House? My initial response is one I typically don't verbalize, that being: Don't bother. Amid concern among Republicans that Democrats are within nanometers of having a filibuster-proof supermajority in Congress, the defection of GOP Sen. Arlen Specter to the Democrat Party is an object lesson in both the duplicity of American politicians in general and the counterfeit nature of altogether too many Republican lawmakers in particular. Practicality dictates that if the GOP isn't going to be any different than the Democrats (as evidenced by their behavior when they had a congressional majority and the White House), why not save their energy and let the Democrats run America straight to hell on white-hot rails? I have found the overtures on the part of Republican politicians to the American left in order to accomplish this "return from Elba" disgusting in the extreme. Rather than examining their own failure as a direct result of spineless gravitation away from conservatism, for some reason they have taken the Democrats' recent successes as an indictment of conservative principles. We know that Obama has moved the United States perilously close to socialism with his policies that have also given us a budget deficit of $1.5 trillion. Obama has held hands with America-hating socialist dictator Hugo Chavez and accepted an America-bashing book from the thug, while offending our ally Britain by returning a bust of Winston Churchill. Obama has indebted our grandchildren and even our great-grandchildren with billions in debt in his first 100 days. He has endangered Americans by his pig-headed insistence on closing Guantanamo Bay prison – even after his own administration investigated and found the facility is safe, state-of-the-art and abides by all Geneva Conventions. To top it all off, Obama's administration spit on our military veterans by labeling Iraq and Afghanistan war veterans as potential terrorists.
